Tickets- General Terms and Conditions

🎨 1. General & Conclusion of Contract
1.1 These General Terms and Conditions apply to the purchase and use of tickets (hereinafter “Tickets”) for the vernissage “here&now” organized by Sahin Dellemann on August 9, 2025, at KitKat Club Berlin.
1.2 The contract is concluded upon binding order and payment (§â€¯312g II No. 9 BGB – no right of withdrawal for leisure events with a specific date).

2. Prices, Payment, and Delivery
2.1 Prices include statutory VAT; additional shipping, presale, and system fees may apply.
2.2 Payment must be made in advance or by card within the specified timeframe.
2.3 Tickets will be delivered as e-tickets; the buyer bears the delivery risk.

3. Personalization & Transferability
3.1 Tickets are personalized (name, email) and non-transferable without written consent.
3.2 Entry is not permitted without providing the required personal data.
3.3 Resale at a profit or via auction is prohibited—any violation will void the ticket.

4. Admission, Access & House Rules
4.1 Admission: Each Ticket entitles the holder to a single entry; leaving the exhibition area voids the Ticket.
4.2 Identity checks and security screenings may be conducted.
4.3 Late admission after the start of the vernissage is allowed at the organizer’s discretion, with no entitlement to a refund.
4.4 Disruptive persons may be excluded; in such cases, no replacements or refunds will be provided.

5. Returns and Refunds
5.1 Returns by the buyer are excluded (§â€¯312g II No. 9 BGB).
5.2 If the organizer cancels the event: refund of the net ticket price (excluding fees) upon presentation of the Ticket, within 6 weeks after the originally scheduled date. Shipping costs are not the responsibility of the buyer.
5.3 If the date is postponed: the Ticket remains valid for the new date. If the buyer is unable to attend the new date, they may request a refund of the net ticket price within 48 hours of its announcement—no fees apply.
5.4 No refund entitlement in the event of force majeure (§312g exclusion).

6. Force Majeure
6.1 Events of force majeure (e.g., natural disasters, pandemics, strikes, official orders) do not entitle the buyer to a refund—except in the case of full cancellation.

7. Liability & Data Protection
7.1 In cases of slight negligence, the organizer’s liability is limited to the net ticket price; liability for gross negligence, intent, or bodily harm remains unlimited.
7.2 The organizer is permitted to take photos, video, or audio recordings during the vernissage and may use them for promotional purposes.
7.3 Personal data will be processed in compliance with the EU GDPR and used solely for contract execution and communication (entry, changes, weekly updates).

8. Final Provisions
8.1 Governing Law: German law; exclusive place of jurisdiction is Berlin, as far as legally permissible.
8.2 Should any provision be invalid, the remainder of the Terms will remain effective (severability clause).
8.3 The organizer reserves the right to change the T&C; the version published at the time of ticket purchase shall apply.
